This is my response to you: 1. If the property is in your mother's name then mother will be sole owner of it; 2. In divorce proceeding if your father proves that he has been paying the maintenance of the shop then he can contest a share in the property (though it will lack full merit); 3. If it is somehow proven to be ancestral then your mother cannot wholly own it.
