    make a complaint against your wife n that person and you can also file divorce on the ground of adultery but you have to produce strict proof

  • you can't file any charges against your wife. it can only become a ground for divorce if you so wish. however, you can file a case for adultery against the guy you think your wife is cheating with. he can be booked under IPC, your wife cannot.

  • Charge of adultery is a serious offence and a serious assault on the basic pillar of the institution of matrimony which is mutual belief. Courts generally tend to ask for direct evidence ie eye witnesses. Other things depend on what are the evidence available with you. Tell me what are with you, then I will advise you on that.

  • You can file a complaint before the criminal court against the offence of Adultery. But it should be born in mind that the charges of adultery should have to be proved beyond doubt and that the wife is living in adultery. One or two instances of flip flops or stray occasions of night outs shall not constitute adultery. The complaint can be made by the aggrieved husband only against the adulterer and against the wife adultery can be used only as a ground for divorce. You have to be an eye witness of the action of fornication of your wife and the adulterer for a successful prosecution.
