I have doubt regarding to maintenance can be allotted to a divorced lady with kid. My wife is living in her native place with my 2 year old age son from last 6+ month, she is filing a case of divorce against with multiple allegations. My income is 10000/- month. I have doubts. (1) Does maintenance will be separate for kid and lady .. What could be maximum amount of my income can be allotted. Generally Case goes to court where marriage happened or couple was living at last, Does girl can transfer it on to her native place by any excuse. ..

1) Yes seperate for each but same order.. Maximum 5k, Normal 3-4k, Minimum 2k.. 2) Anywhere in those 3 places petition can be filed.. Yes she can file/transfer to her native place as per Sec 19 aiii of HM Act..

it can be 3 to 5k if u r earning 10k. if u show u have any loans then it can be less. but 3 to5k can be awarded by court in ur case.

no separate maintenance is allotted. If your wife works or educated enough to get a job then it she will not get for maintenance. As your income is very low.
