Hello, I need your legal advice regarding a service agreement I signed with a visa consultancy. As per the agreement, I was required to pay part of the fee in advance and the remaining after receiving my visa grant notice. However, they took the full amount before showing me the genuine visa grant letter (with TRN and Grant number). It’s now been 2–3 months since they claimed my visa was granted, but they still haven’t provided me the original grant notice or other promised services (employment contract, accommodation, travel). The agreement also mentions a 6-month deadline for providing services, failing which they must refund the amount, but I already see clear breach of contract. Could you please advise me on: -What legal options do I have right now (police complaint, legal notice, consumer court)? -Can I demand a refund before the 6-month deadline due to breach (taking full payment early + failure to provide documents)? Consumer Court (District Consumer Commission) Since this involves “service” and “consideration,” you can file a complaint in consumer court for: Refund of money, Compensation for harassment/mental agony, Litigation costs. You don’t need to wait for 6 months, since breach has already occurred. ✅ Police Complaint (Fraud/Cheating) If you suspect the consultancy has deliberately deceived you (e.g., fake visa grant claim, forged documents), you can file an FIR for cheating (Sec. 420 IPC). Police complaints often push such agencies to settle/refund quickly. ✅ Civil Suit for Recovery You may also file a civil money recovery suit for refund + damages, though consumer court is usually faster and cheaper.
