Defamation is a civil wrong (tort) under Indian law and can be the subject of a lawsuit. However, before proceeding with a lawsuit, it is important to assess the merits of the case and the likelihood of success. To establish a defamation claim, you would need to show that the statement made by the person in the WhatsApp group was false, and that it has caused harm to your reputation. You would need to prove that the statement was made with the intention of causing harm or with reckless disregard for the truth. If you believe that you have a strong case, you may consider sending a legal notice to the person asking them to retract the statement and apologize. If they refuse to comply, you may file a civil suit for defamation. It is recommended that you consult with a lawyer who specializes in defamation law to discuss your options and evaluate the strength of your case.

Yes, you can file a Defamation suit for compensation or a criminal complaint to punish him. Or if you don't want to step up to court or initiate a legal recourse then simply give a legal notice through an Advocate. Open to further queries. Regards, M. K. Vohra & Associates

If he/she is not listening to you then you can always serve him/her a legal notice and in that notice you can write to stop all these harrassment and withdraw the malicious contents from the WhatsApp group. You have to warn him/her that either take down the violating contents or face legal action which will be at your own risk. And if you wish to go legal then you can always forward a complaint in writing to the police station of your area. For more legal assistance I am just a call away.
