A person is eligible to receive gratuity only if he has completed minimum five years of service with an organisation. If an employee completes 4 years and 6 months of continuous service in the same establishment, he is eligible to get gratuity as per the Payment of Gratuity Act 1972. There is also a judgment by the Madras High Court which says that there is the eligibility for the gratuity of an employee who completes 4 years and 240 days of service. But it is advisable to follow what has been prescribed in the law.

Get it checked with the labour inspector of your area, otherwise you have to wait till you complete the mandatory period for your elegibility. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.
