Same-scale Recruitment

Is there any rule/Judgement of Supreme Court of India that 1.prohibit a person in recruitment process to apply for the same post where he/she is employed. 2.if he/she can apply to the same post when he/she is working in that post. 3.Is there is any Judgement of Supreme Court.
