Subject: Legal Advice – Father’s Stay in My Self-Acquired Property
I seek legal advice regarding my father’s continued stay in my self-acquired flat in Ahmedabad, Gujarat. He has lived separately in West Bengal for 13 years and never supported our household. In 2020 he had a stroke; I paid ₹1 lakh for treatment. Recently we managed another hospitalization. He now accuses us of fake bills, verbally abuses my mother, refuses medicines, leaves home without informing us, and causes mental stress.
The flat is solely in my name. He holds Power of Attorney (to be revoked). He contributes nothing and refuses to vacate, threatening false claims as a senior citizen.
Questions:
How can I legally evict him?
Does senior citizen status give rights in my self-acquired property?
How to revoke POA and prevent false harassment claims?
What legal remedies exist if he refuses to leave?
