Immediately file an Ejectment Petition demanding the arrears of rent. The Court will direct the Tenant to pay the rent first and then will eviction order on the grounds You will mention in the Ejectment Petition. 1. you can serve him a legal notice to vacant the premises, 2. if he shows any disregard to the notice, you can file a eviction suit in the court
firstly, lease agreement & tenancy agreement are to opposite pools. if it is a lease agreement, u are entitled for recovery of possession, subject to violation of the terms therein but in the event of tenancy agreement, u can evict the tenant, subject to issuance of Statutory notice under local Rent Act, inter alia on the ground of ur reasonable requirements
give him advance notice through advocate if not vacates the same then file a case for ejection
