I seek the advice against my builder. We booked property in 2017, possession is delayed for more than 2 years. Since last year my bank started deducting my EMI's as a builder was not able to settle his subvention with the bank. My last EMIs deducted in Jan with including the builder's due as well. I have submitted the cancellation request to the builder in February, since then They have not updated me on my cancellation request and the bank is deciding the bouncing EMI charge from me. I need to understand the legal actions that can be taken against the builder and expedite the cancellation process.

file rera case... if builder does not give u ur possession within the period of specified time..then he is liable to return all the amount and with interest..u can claim

if builder does not provide your possession within the period specified in the agreement then he is entitled to return all the amount with interest as specified in the act. You make claim your all amount by filing a complaint in rera.
