Can One Of The Person Build A Building On Land Which Is On Common Name

Our ancestral property is in small village. My father are 4 brothers. The property is still on the name of all of brothers. My father expired and now my name, my brother's name, and my mother's name is added in place of my father. One of my uncle was doing agriculture activities (2 of my uncles in village and one of them was doing all the agriculture activities). Now, we would like to divide the property but still some issues are going on. One of my uncle has started construction of house on the same land (in between of the land and it will be difficult for any other person to occupy other part of land). My question is 1 Is it allowed to him to construct the house without the person of all shareholders. 2. Can I get stay order on this.
