Can my mother (co-owner with me in a flat in housing society) nominate some one else, then can that nominee create problem for me in inheritance after her death. Also if no percentage of owner ship is specified in sales deed or registry but her name is at 1) and mine at 2) does she categorically become first owner.. If yes does she have more right than me. WHAT will share certificate represent in this case..

If she gift/settle the property to someone else, then problem might arises.. (provided society allocation rules to be referred).. Undivided share can be sold unilaterally.. if co-owners, unless the percentage is mentioned in the deed, it is deemed to be 50-50, which can be disproved later upon evidence if challenged.. There is nothing like first and second owner both are equal and have equal rights..
