Dear Sir, It is not a criminal offence at the most a civil case may be filed for getting possession of the property from you.
No you cannot be persecuted under the trespass law but you may face eviction proceedings.
There will be no criminal tresspass, as you are living there with the consent of your owner. You can be liable under tresspass only if you are evicted from the property by the owner, or otherwise, and still you are living there after such eviction of yourself. But still your owner has the right to sue you for the rent outstanding and interest. As well as the owner can also sue you for damages, in addition to the rent and interest thereof, as you have not paid the rent for 5 months.
