    you have already file partition suit. you have to wait till it decide. your uncle must have to appear before the Hon'ble court don't very if your uncle avoid to appear there is another process of law to decide your case in your favour...

    it's in the court let it decide, you need not worry, whether Ur uncle attends or not it will be decided as per law. you will have ur share accordingly. he will be declare ex-parte and decree will follow if he doesn't attend the court proceedings after sufficient notice. Court will take its time to decde just have patience
