Flat Purchase In Residential Building

I was about to purchase a flat constructed in the name of residential building (Builder says it does not come under apartment category), It has G+3 floors (Stilt + Ground + First + Second), 6 flats constructed out of 40 x 60 = 2400sq ft area, Land is under A khata and flat is also in A khata, I am looking to purchase a flat in second floor, However LIC, Bajaj finance went through the property docs and willing to provide loan. The builder says OC and CC not required since it has only 6 flats constructed and A khata has already made for individual flats, also the building has approval for G+3 and 4 flats but builder has constructed 6 apartments and G+3 remains same, Do we really need OC and CC from the builder in this case and the deviation in no of flats constructed is legal?
