We purchase commercial property. As per sale deed, we were indemnified against any loss due to the non-payment of any taxes liable to be paid before the date of the sale deed. However, we received notice by municipal corp. for payment of property tax which was not paid since long and arrears were there for the period before the sale deed. may we send a notice to reimburse the taxes paid by us for the period before sale deed signed?

Yes you can send notice to your vendor for reimbursing the amount paid by you to the Department, under the agreed clause of indemnification referred in your Sale Deed. Further, if he / she fails to honor your notice, you can file suit for recovery of money.

It is advisable under the circumstances to get a Legal Notice served upon the previous owner of the property agitating for your right.
