file suit against your uncle for recovery of possession

if the property in joint name then file partition suit,if some property only on your mother s name then file a FIR for trespassing and illegal possession.

File a suit for partition of the property claiming mesne profits also for the period the property was in the hands of your uncle. Mutation does not make any difference. Also claim damages for the items sold. Take out an Adv commission to assess the rental income and about the tenants and other income from the whole property. File an Application in the suit for granting injunction from sale, or any disposition of the entire property and committing any waste in the property till the proceedings in the suit is over.
