    There are certain missing links in your narration. There is no Will, probably there is no document regarding your family partition also. Under these circumstances you have to go for Partition of the total property of your Grandfather because all the legal heirs of your Grandfather are equally entitled for their share. It is advisable that you go for a Suit for Partition to get your share.     Dear Sir, As per your narration, in the non existence of the will of your grand father. Then all the sons are the equal shareholder of the grandfather property Therefore it is the ancestral property belonging to you. you can file a suit for your share as well as in the view of the construction of the new planned area. you may file an rti for asking to provide the building map plan for the existing land. Accordingly, if there is no share distribution agreement between the family. then you are entitle to claim your share.
