Is there any provision in law if when three brothers who work in a single shop together and then after 10 years one of them ( the middle one) gets separated because of his ill practices like slacking off and drinking. Provided him a shop to work upon after his marriage which is named after the mother. And living in the same house jointly. Later also the youngest get separated taking his share of separation willingly. But the middle brother remained just like that. Also, the house in which the eldest and middle brother are living together in floors is named half on his name and the remaining is named to the eldest. So does he possess any legal rights on the shop in which he is working for 8 years and which is named after the mother who is living with the eldest son?

Dear Sir Normally it will be recognized as HUF (HINDU Un divided family) business .you can ask them to approach civil court as it is very difficult to prove the same and claim the share .Please give me RANK FIVE (5) If my answer satisfies you

The question needs some more clarification for properr reply. The nature and system of separation of brothers has not been mentioned. And now when the property is in the name of the Mother no one else has the right during the lifetime of Mother. But still it is required to be known that what is the nature of the property. Ancestrial or self acquired? That will be helpful for replying more accurately. he has no right on the shop which is in your mother name but after her death it will be divided in equal share of her legal heirs if died without any will
