    Since, your sister is definately a legal heir of her deceased husband property. and her inlaws have equal rights in this property. if, she had paid for the loan then she can file a declaration suit and challenge the title of the property on the basis of benami transaction, we must Analyse this case, u can contact me for advice, give 5 rating thanx

    Dear Sukhwinder, As per Hindu Succession Act, If a male Hindu dies interstate ( without making any will) his property shall go to First Class legal heirs i.e. Mother, Spouse (Husband or wife) and son or daughter. Each one will get his/her share. If this property (purchased plot) is registered in the name of your brother in law then the same willbe divided among above mentioned persons.
