Hi,
I am a Male, Married, Hindu who bought an apartment in July 2014 in Mohali, Punjab. I bought it for 21L including registry. I got 16.75L as home loan and rest was down payment. I have been paying EMIs regularly (INR 16331 per month). I got this property registered under my name and my mother's name to save on registry cost.
My mother expired in 2017. We are 3 siblings (2 Sisters, one is married).
My First question is:
If I want to sell this property, do I need to get approval/NOC from my father and sisters as 50% property is under my Mother's name.
Second Question:
I had a family dispute with one of my sister. So I am not sure if she will sign NOC without taking anything.
Now, is there any way, where I can tell my lending bank to keep my property and they can sell it as I don't want to pay EMI's any more. But without any effect on my credit score/history.
