Rent Suit

Hi, in case of a pending partition suit for a joint property,and the property with some tenant paying rent to a defendant only, how does filing rent suit work in this case. with a legal notice already sent to tenant and returned, how does the rent suit work. if i had to make the tenant deposit in court, how long will the who process take. will the court pass a instant order to mke the tenant deposit rent to court or will it again goes through a process of hearing tenant side , trial ,etc etc
