Yash.. first of all... let the first transaction be completed.. it means let the seller purchase that property vide articles of agreement... and let him get the possession receipts.. and then you purchase from him... or let him cancel the first agreement... then you can buy the said property... if you wanna avail loan for the same... you have to follow these options...
dear yash .. there are many issues to be considered.. in which state is the property? what is amount paid by seller to builder? what is our total pruce? what is bank loan amount availed by seller? how much loan you want to avail? how much time is required to obtaining of cc by builder? etc.
I don't think any bank would give you loan merely on an agreement to sell whereas it shall be mandatory to provide sale deed to avail loan from any bank, yes private financers may give you loan in such case but they are not all that reliable.
my suggestion is that first of all you should ask the previous buyer abt NOC if is not with him, then wait because buying a not approved flat is not an excuse in eyes of law.
