after the death of father the property will be divided in all his legal heirs
Since the Property has flown to your Mother from your Father. But it has got to be transferred to all the Class-I legal heirs of your deceased Father. It is noteworthy that no Class-I Legal heirs can be left out of it legally. Even Your Mother cannot deny the Legal right to Your Brother. It is the exact Legal position.
