Real Estate Plot EMI\'s Not Returning

Filed a real estate case in consumer forum. But Defendant failed appearing twice in Court. And next hearing will be on Feb\'17 2020. 1.Please let me what happens if Defendant fails appearing even 3rd time!! 2.Will Defendant go for appeal after final judgement. ( Case - Paid half of the EMI\'s for a plot and unable to pay the remaining EMI\'s from 2015 onwards and asking them to return my paid EMI\'s but they didn\'t. )
