I filed a criminal case us 420, us406 for non payment of my dues.The judge now says that the case can be considered us 420 only if demand notice is given to the accused.please advise in this matter regarding mandatory service of demand notice to the accused.

Dear Sir, The Court has ample powers to alter the sections. After dealing evidence you may file an application to include Section 406 also if sufficient evidence is brought on record by your side.
