Dear Sir, Sometimes the Magistrate may not receive such private complaint unless you produce an acknowledgement from the police having filed complaint. There is no format to file private complaint however you can find out one such format online. Appointment of advocate is not necessary. Dear Client in that situation you should file Complainant before Magistrate through Council where the statement of the complainant will record and then 202 Cr.P.C. where the statement of the witnesses will record thereafter Court will apply mind if he thinks it's a good case and have gravity then summon the accused under section 204 if not then reject under section 203 and as per my point is concern you should approach under section*Phone*Cr.P.P. it's a better option compare to 200 for more clarity you may contact us.
