    This Act applies to: 1. Every factory, mine or plantation (including those who are belonging to Government) 2. An establishment engaged in the exhibition of equestrian, acrobatic and other performances, irrespective of the no of employees, and 3. Every shop or establishment wherein 10 or more persons are working on any day of the preceding 12 months. Latest amendment in the Act : According to the latest amendments to the Maternity Benefit Act 2017, maternity leave is raised from 12 weeks to 26 weeks. The prenatal leave is extended from earlier 6 weeks to 8 weeks and 18 weeks post the childbirth. So, you can take legal action against your employer if you have worked 80 days in the last 12 months in the company.

    All the company whether private or public must go by the government rules as every working woman is entitled to get the maternity leave of 12 weeks along with the salary there is no discrimination in that if you find any difficulty in that you could give one complaint to your higher authority.
