Ms. Shweta, On the basis of the details youve provided, it appears that the actions of the third party in preventing you from joining the company are not their sole discretion but also approved by the company. I believe that the company's suggestion to you, that you should resign and join through another third party was also ill motivated and designed to make you leave without any hassle on their part for which they have shifted the burden and blame on the third party but it appears to be a joint initiative by both of them. if youre interested in joining the same company, we have the following options: a. A consumer notice to third party. They come within the purview of a service as per consumer protection act and they have been sabotaging your employment with the company for their own interests. b. In addition to the above, a notice to the company and the third party addressed collectively where we convey to them that they have wrongfully and on misleading grounds, induced your resignation to gain undue advantage and we demand reinstating of your position at the company and if failure to do so on their part, then a suit for damages. c. we send them both a notice for cheating and fraud which is a criminal offence but in this case having your position at the company back will not be an option. d. we send them a notice for breach of contract and ask for reinstating your employment. I shall be able to assess more accurately once I know more details and employment terms.
