I have given office space on rent having agreement on 100 Rs stamp paper with the tenant. Tenant is running one Marketing company. I collected Tenant GST number proofs and all ID proofs along with the agreement. He has given 4-month advance Security deposit Postdated cheque to me. Now within a week after I come to know he was running money networking scheme and took money from about 20 customers. As he was cheating with customers, they put the complaint in Police and police came and lock the Office space. Also, the advance cheque which he provided to me got bounced. Now ofc is closed and keys are in Police station. Tenant is not picking my phone and responding on WhatsApp. What should I do now? If Police file the FIR against him then as a landlord, what are the problems I can face here? What should be next action as still, police did not register the FIR against him.

Dear Sir, You immediately file a civil suit for eviction since he is indulged in illegal business. Secondly approach High Court to issue a direction to the Investigation Officer to open your shop and hand over the same to you. If any complaint is lodged against him, by any of the public for having cheated them, FIR will be lodged against him and charge sheet will be framed and cheating case will be filed in the magistrate court and you could be summoned by the court as one of the witnesses as u have given you room for rent.
