There was a jointly owned property having 3 co-owners. One of the co-owners executed a notarised Relinquishment Deed without consideration in favour of the other one co-owner, and based on this notarised deed, mutation was carried out in the revenue records in favour of the one co owners. Subsequently, remaining two owners developed the property into 4 plots and sold them separately. My customer has purchased one of these plots through a registered sale deed and has now approached our Govt Bank for a loan.Our Bank's approved advocate has raised an objection that he cannot conduct a clear title search because the transfer of the third co-owner's share was based only on a notarised Relinquishment Deed. Kindly advise whether the title can be considered legally clear in these circumstances, whether the existing mutation and subsequent registered sale deed can sufficiently establish the customer's title, and if not, what document or legal rectification should be obtained.
