    if there is no partition and death was not occured before 2005 then you can institute suit for partition and separate possession

    Dear Shivam As per 2005 amendment in Hindu succession act provisions, Now, female can claim her share. If her brother denies her claim then she has legal right to file partition suit in civil court of the concerned district where your property is situated.
