From the facts mentioned by you, this appears to be a serious property ownership dispute between spouses, and the outcome will depend largely on the documents, pleadings, source of funds, intention behind purchase, and the exact relief claimed in the pending case. Prima facie legal position: Since the registered sale deed stands in your name, you do have a strong documentary title on record. However, at the same time, if your husband is able to show: - that the entire or substantial purchase consideration came from his funds, - that you had already declared before the Income Tax Department that the property was purchased from his income and not yours, - and that the transaction was structured in your name only for convenience, then the matter may become legally contested on a much deeper level. Therefore, this is not a matter to be handled casually. To assess how you can defend the case, the following will be very important: 1. Copy of the sale deed 2. Copy of the plaint / suit filed by your husband 3. Your written statement / reply, if already filed 4. The Income Tax notice and your declaration 5. Bank statements showing the payment trail 6.
