Can RWA charge maintenance for the private terrace of the Pent House in an apartment? Out apartment has been charging maintenance on an Hybrid model, part fixed & remaining as per sq ft area basis. So, we recently came to know, that the pent house owner had not disclosed the additional area covering the Private Terrace accessible only to them to the RWA. Therefore, now we the management want to charge/ add this additional area as specified in their(Pent House) sale deed for maintenance calculation. Kindly suggest if we as the RWA can go ahead with this! Thanks!

Dear Sir, Since because the Resident of Pent House using additional area covering the private terrace is liable to pay additional maintenance as may be decided by the Management. If aggrieved the said person may go to Civil Court and in the meanwhile you can recover arrears of such additional maintenance.

Issue them notice through lawyer and File Complain in Consumer Court and claim heavy compensation.
