I am a tenant of my flat which is under construction in a redevelopment project by a private builder in Mumbai. The status of work is 80% construction is over. My builder has done a registered agreement with all the tenant 3 years back. The agreement states that my flat is on an ownership basis. The builder has mentioned a point in agreement that the tenant shall not be entitled to transfer the same in any manner except to legal heir without obtaining written permission from the owner i.e. builder or condominium in accordance with MHADA Act and as per NOC received by MHADA. My question is can I sell my flat at this point. As I have come to know by sources that few of the tenants have sold their flat.

Dear Sir, If other tenants sold then get certified copies of the same as they are available in Sub Registrar Office and on the same terms sell your flat also.
