Regarding Termination

Hi, We have an employee who joined as Manager – Finance but went on maternity leave. During her absence, we onboarded a Chartered Accountant with controllership expertise, and as a result, the original Manager – Finance role has evolved/changed significantly.Now that she is rejoining, we are evaluating options since: The earlier role does not exist in the same form, The current business needs require qualifications/skills different from her profile. Whether termination on grounds of role redundancy is legally safe in this situation, considering Indian maternity protection laws. Our company can pay severance pay.
