  • Sunil ji what you have to do is send a legal notice to them within 30days from the date of memo and after that file a complaint u/s 138 NI Act and also file a suit for recovery because in 138 NI Act there is only punishment there is no provision of getting your money recovered.

    First of all send a demand notice within 30 days of the day the cheque bounced, calling for payment within 15 days of the receipt of notice by the party. If no payment comes forward you can file a criminal complaint under section 138 of the NI act within 30 days from the expiry of the above mentioned period of 15 days.

    yes uh can present the cheque in the bank third time... after the cheque bounce third time obtain a bank memo... Nd send him legal notice under 15 days ... nd ask him to pay the money under 15 days of notice received.
