Hello team of advocate sir, Pls provide ur thought over the query: In 138-NI Act, the accused was not attending the last 7-hearings till judgement of my case sir and he was convicted on Feb2025. For an another similar kind of case, he was in the jail from Mar2025-April2025. Now the accused has filed an appeal in district court on June2025 with condone delay petition. Is it possible to cancel his appeal by filing an objection petition? What should be the main content we can represent in the court for cancellation of the appeal petition. I need support on this concern Thanks, Brinda

As you stated that accused has filed appeal before session court along with condonation of delay it is advisable for your kind information that you have legal right to contest the same appeal by filing appropriate reply to the same after receiving court's notice. To delay the condone is the discretionary right of the Judicial officer.
