Cheque Bounce By Party Against Supply Of Goods

Cheque received by a party was returned unpaid by the bank.can I file cheque returned case against the party in the court. The party is ready to give my goods against which cheque was issued but I am not interested to take goods back.can I still file cheque returned case? Pl advise urgently?
