Options For Pursuing A Cheque Bounce Case

I had made a payment of RS 4,57,000 as advance for purchase of a plot in a farm land in West Delhi which the dealer confirmed to us that it is being converted into dwelling area. however the land could not be converted and hence the dealer issued me a cheque for the same amount as advance paid after the deal fell through. however the cheque bounced on deposition due to insufficient balance in the dealers account. please advice on the options open to me after i issue him a legal notice of cheque bounce. can I also file a criminal case under IPC for cheating in addition to filling a suit under 138?
