My father filed a cheque bounce case in 2017 at civil court and court has issued summon ( Under NIA Act 138 ) to the defaulter party as well in 2019, but he never appeared. In between, my father expired in 2018. So, Can this case be transferred to me and what can we do, if the defaulter party is not appearing in the court.

Dear Sir Yes it can be transferred in the name of you as you are son of complainant. You may get warrants against defaulter by furnishing correct address of him.
